Terms of Service

Please read these Terms of Service ("Terms") carefully before using EXL Realty Group (www.listwithexl.com), a flat-fee MLS listing platform operated by EXL Capital Group, LLC dba EXL Realty Group (Texas Real Estate Broker License #9015220) ("EXL Realty Group," "we," "our," or "us").

By accessing our website, purchasing a listing plan, or using any feature of our platform — including the offer submission portal — you agree to be bound by these Terms. If you do not agree, do not use EXL Realty Group.

1 Acceptance of Terms

These Terms constitute a legally binding agreement between you and EXL Capital Group, LLC dba EXL Realty Group. Your use of EXL Realty Group constitutes acceptance of these Terms in their entirety, including any updates posted at www.listwithexl.com/terms. If you are using EXL Realty Group on behalf of a business or other legal entity, you represent that you have authority to bind that entity to these Terms.

2 Description of Services

EXL Realty Group provides the following services for a one-time flat fee:

  • MLS Listing: Publication of your property on NTREIS (the North Texas Real Estate Information Systems MLS), the primary MLS serving the Dallas-Fort Worth metroplex.
  • Syndication: Automatic distribution of your listing to Zillow, Redfin, Realtor.com, Trulia, Homes.com, Homesnap, and 100+ additional real estate websites.
  • Offer Portal: A direct offer submission portal enabling buyers and licensed agents to submit offers to you electronically.
  • Rental Listings: MLS listing and syndication services for landlords listing residential rental properties.
  • Ancillary Services: Optional add-ons including professional photography coordination, 3D tours, contract review guidance, showing coordination, and more, as described on our website.

EXL Realty Group acts as the listing broker of record for all properties listed through EXL Realty Group. This brokerage relationship is governed by the Texas Real Estate Licensing Act and TREC regulations. You remain the principal in your transaction and retain full decision-making authority over price, offers, and terms.

EXL Realty Group charges zero percent commission at closing. Your flat fee is paid once at the time of listing.

3 Eligibility

To use EXL Realty Group you must:

  • Be at least 18 years of age.
  • Have legal authority to list, lease, or sell the subject property (e.g., be the owner of record, an authorized representative, or hold a valid power of attorney).
  • List a property located within the NTREIS coverage area (Dallas-Fort Worth metroplex and surrounding counties). Coverage in other Texas markets will be noted on our website as it becomes available.
  • Provide accurate and complete information about the property being listed.

Agents or brokers listing on behalf of a seller must disclose their license status and comply with all applicable TREC rules and MLS policies.

4 Listing Plans and Payment

EXL Realty Group offers three listing plans. All prices are one-time flat fees, charged at the time of purchase:

Payment Processing: All payments are processed securely by Stripe, Inc. By completing a purchase, you also agree to Stripe's Terms of Service. EXL Realty Group does not store your card number or billing details.

⚠ Online Checkout — In Development: Our self-serve online payment portal is not yet active. To get started, contact us directly at (469) 829-7863 or info@exlgrouptx.com. Payment instructions will be provided after we confirm your listing details. These Terms will apply in full once payment is collected.
Refund Policy: Because your flat fee covers the cost of submitting and activating your listing on NTREIS, fees are non-refundable once your listing has been submitted to the MLS. If your listing has not yet been submitted (e.g., your listing form is incomplete or unsigned), you may request a refund within 48 hours of purchase by contacting us at info@exlgrouptx.com. Add-on fees are non-refundable once the service has been delivered.

5 Seller and Landlord Responsibilities

By submitting a listing through EXL Realty Group, you represent, warrant, and agree that:

  • All property information you provide — including address, description, price, square footage, and disclosures — is accurate, complete, and not misleading.
  • All photographs and media you upload are owned by you or properly licensed for use in a real estate listing, and do not infringe any third-party intellectual property rights.
  • You have completed and will provide all Texas-required disclosures, including the Seller's Disclosure Notice (TREC Form OP-H) where applicable.
  • You will comply with all NTREIS MLS rules and regulations, including requirements for listing accuracy, photo standards, and timely status updates (e.g., marking the property as pending or sold).
  • You understand that listing in the MLS may result in buyer's agents submitting offers and that you, as the seller, are solely responsible for evaluating and responding to all offers.
  • You will notify EXL Realty Group promptly of any material changes to the property or listing status, including going under contract, closing, or withdrawing the property.
  • You will comply with the Fair Housing Act and the Texas Fair Housing Act, and will not discriminate in the sale or lease of your property on any protected basis.
Important: Providing false or materially inaccurate information in an MLS listing may violate NTREIS rules, TREC regulations, and applicable law, and may result in immediate removal of your listing without refund.

6 Buyer's Agent Commission

EXL Realty Group charges zero commission at closing. You may, at your sole discretion, offer a buyer's agent commission (also called a "cooperative compensation") in your MLS listing. This is entirely optional.

If you elect to offer a buyer's agent commission, you are solely responsible for setting that amount and for honoring it at closing. EXL Realty Group is not a party to any commission agreement between you and a buyer's agent.

If a buyer submits an offer without representation (unrepresented buyer), TREC requires that the buyer acknowledge EXL Realty Group's agency relationship with you as the seller prior to offer submission. Our offer portal captures this acknowledgment electronically.

7 Offer Submission Portal

⚠ Portal Under Development: The EXL Realty Group online offer submission portal is currently under development and not yet available. Until the portal launches, buyers and agents should submit offers directly to sellers via contact information provided in the MLS listing remarks. These terms will govern portal use once it is live.

EXL Realty Group's offer portal enables buyers and licensed agents to submit purchase or lease offers directly to you. By using the portal:

  • Sellers: You acknowledge that submitted offers are delivered to you as the principal. EXL Realty Group does not evaluate, negotiate, or advise on offer terms unless you have purchased an MLS Elite plan that includes contract guidance.
  • Buyers (unrepresented): You acknowledge that EXL Realty Group represents the seller and not you. You are advised to seek independent legal or real estate advice before submitting an offer.
  • Licensed agents: By submitting an offer through the portal, you confirm that you are a duly licensed Texas real estate agent or broker, that you represent the buyer, and that your TREC license number is accurate as provided.

EXL Realty Group is not responsible for the outcome of any negotiation or transaction resulting from offers submitted through the portal.

8 Listing Changes and Cancellation

  • MLS List: Includes up to 10 listing changes (price updates, photo updates, description edits, etc.) during the listing term.
  • MLS Plus & MLS Elite: Include unlimited listing changes for the life of the listing.
  • Cancellation: All plans may be cancelled at any time with no cancellation fee or penalty. Upon cancellation, your listing will be withdrawn from NTREIS within one business day. Flat fees paid are non-refundable after listing submission, per Section 4.
  • Expiration: Listings that reach the end of their term without renewal or sale will be automatically withdrawn from the MLS. You may renew your listing at the then-current plan rate.
Cancel anytime. No cancellation fees. Ever.

9 Intellectual Property

The EXL Realty Group platform, including its design, code, branding, and content created by EXL Realty Group, is protected by copyright, trademark, and other intellectual property laws. You may not reproduce, distribute, or create derivative works from our platform content without written permission.

By uploading photos or other content to EXL Realty Group, you grant EXL Realty Group a non-exclusive, royalty-free license to use, display, and distribute that content solely for the purpose of publishing and syndicating your listing. This license terminates when your listing is withdrawn or cancelled.

10 Prohibited Uses

You agree not to use EXL Realty Group to:

  • List properties you do not own or are not authorized to list.
  • Provide false, misleading, or fraudulent property information.
  • Violate the Fair Housing Act, Texas Fair Housing Act, or any anti-discrimination law.
  • Circumvent, disable, or interfere with security features of the platform.
  • Scrape, harvest, or collect data from the platform for commercial purposes without written consent.
  • Use the platform in any manner that violates NTREIS MLS rules, TREC regulations, or applicable law.
  • Transmit spam, malware, or any harmful code through the platform or offer portal.

Violation of any prohibited use may result in immediate suspension or termination of your account and listing, without refund.

11 Disclaimers

EXL Realty Group provides a platform for listing and marketing your property. We do not guarantee:

  • That your property will sell or lease within any particular timeframe or at any particular price.
  • The accuracy of automated valuations, market analyses, or CMA guidance provided as part of our service. These are informational estimates only and do not constitute an appraisal.
  • Uninterrupted or error-free operation of the platform or the NTREIS MLS system.
  • The conduct, representations, or solvency of any buyer, seller, agent, or third party you interact with through the platform.

THE PLATFORM AND SERVICES ARE PROVIDED "AS IS" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW.

12 Limitation of Liability

To the maximum extent permitted by Texas law, EXL Capital Group, LLC dba EXL Realty Group shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising out of your use of EXL Realty Group, including but not limited to lost profits, lost sale proceeds, or data loss.

Our total cumulative liability to you for any claims arising under these Terms shall not exceed the amount you paid to EXL Realty Group for the specific listing plan giving rise to the claim.

13 Indemnification

You agree to indemnify, defend, and hold harmless EXL Capital Group, LLC, EXL Realty Group, their officers, agents, and employees from any claims, losses, damages, liabilities, and expenses (including reasonable attorney's fees) arising out of: (a) your use of the platform; (b) your violation of these Terms; (c) inaccurate or misleading listing information you provided; or (d) your violation of any applicable law or third-party right.

14 Governing Law and Dispute Resolution

These Terms are governed by and construed in accordance with the laws of the State of Texas, without regard to its conflict of law provisions. Any disputes arising under these Terms shall be subject to the exclusive jurisdiction of the state and federal courts located in Dallas County, Texas.

Before initiating any legal action, you agree to contact us at info@exlgrouptx.com and provide a written description of your dispute. We will attempt to resolve the matter informally within 30 days of receiving notice.

15 Changes to These Terms

We reserve the right to modify these Terms at any time. Changes will be posted on this page with a revised "Last Updated" date. If you have an active listing at the time of a material change, we will notify you by email. Continued use of the platform after the effective date of any change constitutes acceptance of the revised Terms.
